Terms and Conditions for Commissioned Artworks

These Terms and Conditions (“Agreement”) govern the services provided by Leletart Limited, hereafter referred to as “the Company,” for commissioned artwork. By submitting a picture to the Company or engaging in a commission, you (“the Client”) agree to these terms.
- Commission Agreement
Upon submission of a picture or image for commission, the Client grants the Company the right to use the submitted image as reference material for the creation of a commissioned artwork. By submitting this image, the Client affirms that they hold the necessary rights to the picture and have the authority to grant the Company permission to use it in this manner.
- Copyright and Ownership
- The Company retains the full ownership and copyright to the artwork created, including any digital images, paintings, drawings, or other forms of visual representation.
- The Client acknowledges and agrees that the submitted image serves only as a reference for the commissioned artwork and does not transfer any copyright to the Client.
- The Client agrees that the Company has the right to use the final artwork for promotional purposes, including on the Company’s website, social media accounts, and other marketing materials.
- If the Client requires a full transfer of copyright for the artwork, such an arrangement must be negotiated and agreed upon in writing, and may involve an additional fee.
- Data Privacy and GDPR Compliance
- The Company is committed to protecting the privacy of the Client’s personal data and adheres to the General Data Protection Regulation (GDPR).
- Any personal data provided to the Company, such as the Client’s name, email address, and shipping information, will be collected, processed, and stored in accordance with GDPR guidelines.
- The Client’s personal data will only be used for the purpose of fulfilling the commissioned artwork order and for communication regarding the status of the commission.
- The Client has the right to access, correct, or request the deletion of their personal data at any time. Please contact us at info@leletart.com for such requests.
- Submission of Images
- By submitting a picture to the Company for commission purposes, the Client grants the Company irrevocable consent to use the image as a reference to create the artwork.
- The Client confirms that the image provided is either their own work, or that they have obtained full permission from the original creator or copyright holder to allow its use for the purpose of artwork creation.
- The Company will not be liable for any copyright infringements related to the image submitted by the Client.
- Commission Process and Timeline
- The typical timeframe for completing a commissioned artwork is 4-6 weeks. However, the exact timeline will be confirmed after the order is placed and the scope of work is agreed upon.
- The Company will provide updates throughout the process and notify the Client of any significant delays. If a specific delivery date is required, the Client must communicate this upfront, and the Company will attempt to accommodate it, though no guarantees can be made.
- Payment and Pricing
- The total price for a commissioned artwork will be agreed upon before work begins, based on the complexity of the project and the medium used.
- A non-refundable deposit of 50% of the total price is required to initiate the commission, with the remainder due upon completion of the artwork.
- Payments can be made via all appropriate card payment methods & PayPal, and all payments are due according to the payment schedule outlined in the commission agreement.
- Cancellations and Refunds
- Once the commission is in progress, cancellations will not be accepted, and deposits will not be refunded.
- If the Client decides to cancel the commission before work has started, a full refund of the deposit will be issued.
- If the Client is unsatisfied with the final artwork, the Company will work with the Client to resolve any concerns. However, refunds are not available for completed works unless there is a clear violation of the agreed terms.
- Limitation of Liability
- The Company is not liable for any damages, losses, or legal issues arising from the Client’s submission of copyrighted images or their failure to obtain appropriate permissions for images used in the commission.
- The Company is also not responsible for any indirect or consequential damages arising from the commission process or the final artwork.
- Governing Law and Dispute Resolution
This Agreement will be governed by the laws of the Republic of Ireland, and any disputes will be resolved through the relevant court proceedings.
- Amendments
The Company reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Client and will take effect immediately upon posting on the Company’s website.
